Lawyer Reviews of the Activision Blizzard Lawsuit (Videos)

Recommended Posts

We have two videos going into the details of the actual lawsuit aimed at Activision Blizzard, from how the California Department of Fair Employment and Housing works, opinions on the suit's outcomes, what exactly the details mean and a lot more.

It's important to note that these are just the opinions of two lawyers that are trying to explain the suit as best they can and should be considered as such. The first video is more about the claims themselves, more from a defense attorney standpoint. Here's the individual chapters so you can skip to the section that you want:

00:00 Introduction 03:17 How a DFEH (CA) Complaint Works 06:10 Setting the Groundwork (CA's Introduction) 11:18 Equal Pay: CA's Main Complaint (and Mistake) 16:45 "Cube Crawls" and Harassments 22:40 The CA Laws At Issue (Jury Instructions) 28:01 Prior Complaints and Mediations (Date Issues) 33:38 The Alleged Causes of Action 47:10 CA's Examples (Discrimination) 1:02:00 CA's Examples (Harassment) 1:10:37 Activision's Response 1:16:53 Conclusion.

The second video goes into more detail on the California Department of Fair Employment and Housing, what the agency actually is, how the relevant law differs in California from the rest of the US, the investigation prior to the suit, and generally focuses more on the context surrounding the suit than the specific claims.

Though I'm glad that the people responsible will be punished, in the long run, Blizz will still be around. Look at Riot games, same exact thing happened. Hopefully we get some quality changes at least

I don't think I care about a single company enough to listen to law mumbo jumbo to explain how they're going to weasel out of facing consequences.

If it's civil lawsuit, not a criminal one, then this is less likely. Some fines perhaps, unless it's going to escalate further.

I think that's missing the mark a little.

It's not law mumbo jumbo", it's explaining some context and legal precedent.

It's also not "explain they're going to weasel out". Lawyers exist on both side of the law (it's how it all works really lol) these lawyers are explaining and giving opinion on how they DFEH could likely win. Define what the bedrock the entire case is build on, if it's stable and so on.

You're comment makes it seem like every single lawyer's job is to find a loophole that makes it so unethical things can be gotten away with. You should put my faith in the legal system, it's a done a ton of good and at the end of the day, it's a jury of us peers that typical pick the outcomes. Lawyers are there to make sure someone doesn't get hung for stealing a pencil in grade school.

It is indeed a civil lawsuit, so no jailtime for anyone, however it's easier to get a conviction which may pave the way for criminal ones down the line, from what I've read around the subject.

Depends on the statute of limitations and the individual cases involved. I don't know what California's laws are, but cases as old as 10+ years could be outside the statute, and thus be ineligible for criminal prosecution. Thus leading to a civil case in this instance.

Didn't think of that, good point.

(for me @59 mins )

ok, whew. What a couple of long videos.  Very interesting to see what a couple of lawyers see in this lawsuit and their explanations.  Again, thanks for posting of these two videos as I would have never found them.

Big american corporations sound like an awful workplace for woman. glad my country does it better

After being in the US Military for 22 years (retired in 1993) and stationed at a lot of places over seas, I found that a lot of countries in the world has problems like this, if not more so.  You didn't say where you are located.

i never said, that no one does it worse. the united states are on rank 30 out of 156 countries in the Global Gender Gap Index in 2021 so there plenty countries which are worse (also america increased 23 ranks since 2020). its just that you most likely only hear of big american corporations lately + ~1 1/2 years ago the big reveal about hollywood and harvey weinstein.

Im from norway but living in germany

Neither did I say what you think I said - "i never said, that no one does it worse".   🙂    And it is sad, everything one seems to hear about these days is how bad it is over here, yet, more and more people keep coming every day to live here.

I am just hoping that now since this lawsuit, WOW will design the character women better, not looking like barbie dolls.  Armor that doesn't show so much skin. The dancing for gold, etc.  Remove all the sexual innuendos in both the story lines and from players nasty names that males think are cute, the *filtered* talk that is not appropriate in  general talk or whispers and take serious the reporting of said behavior. (there is only so much space devoted to "ignore" and I have reached it).  Maybe with the work place hopefully getting better, we won't have to put up with this garbage in the game.

i dont think that will happen. i think they will just remove some references.

im ok with letting everyone modificate the characters body the way they personally like but i also think that wont happen soon (maybe as a feature in another expansion or a bigger content patch)

as a female blood elf mage im ok with my selection of transmog, i barely got anything that reveals much. isnt the amount of "sIut-mog" transmog in general pretty small compared to the "normal" amor and cant the parts be used as "normal" amor separately ? anyways here i wouldnt agree  with you, i think everyone should be able to transmog the way they like.

The dancing for gold

maybe thats just an US thing? in 17 years of wow i havent seen someone offering a dance for gold on my realm(s) but i've never played on a roleplay realm. also only time i heared about *filtered* for gold in wow was when i watched the big bang theory

the story lines are way too much for me to remember them all so i cant really say something about that and much of that might also be lost by translation, at least except for a few bad jokes or references (millhouse manastorm talking about not dropping the soap in prison or a slippery novel) i cant really remember something sexual innuendos. but by far i havent done all quests available

whats an example for that? also saying thats only done by man is generalizing and an assumption. its like saying all germans are naz*s (which more people still say then you would think, especially in online games). anyways im ok with cute names, sexualized names on the other hand shouldnt be allowed and its reportable as far as i know.

that should indeed taken more serious if its done. but i never witnessed this behavior based on my (or someone else) gender or the gender auf my character, more like toxic behavior when someone has a problem with your playstyle, your auction prices or something you said in the chat. i can imagine that if you admit beeing a woman in all chat or to randoms you just met this could change but i rarely reveal my gender to anyone and only using voice while talking to guild or premades.

since i switched to a bigger realm ~4 month ago i use global ignore list addon and can put unlimited numbers of people onto ignore also another addon is badboy

Wow, I wasn't expecting a huge breakdown and analyzing of my simple message like this.  I think you are still reading way too much into what I write.

But to quell your concerns, again, all I said was that I wanted a few more choices (as does my daughter and sister who plays the game) for the armor to be the same as the male armor.  Nothing about limiting yours or others for their trans-mog choice.   And for all the other breakdowns you did, just remember, what I see is different to what you see in the game.

But I do want to thank you for mentioning of that global ignore list add-on! I will need to find it. (I have only use a couple of add-ons thru out the years, so this will be new).

LOL, it's ok, chatting with you reminded me of the fun times of the heavy discussions with friends in my favorite gasthaus in Wiesbaden back in the 80s. Only difference is not able to buy each other a bier 🍺 afterwards.  😀  you too, take care.

Gamescom is back in August this year, and Blizzard have announced they will be present at the Xbox booth!
The event starts on August 21st and runs until the 25th, with War Within, the next WoW expansion, releasing a day after that (or right in the middle of the show on the 23rd for those with early access), so we might get some exciting news on it at the show. Then there's Vessel of Hatred, the new Diablo 4 expansion, as we should get some new info on it as well, with its October 8th release date also looming. The press release also mentions Diablo Immortal and Overwatch 2 will be involved.
Xbox also announced this year they will have their biggest booth at the event yet, with the Activision Blizzard merger certainly helping with that!
And here's the full press release.
      gamescom
Blizzard Entertainment® is thrilled to confirm their presence at this year’s gamescom, returning to Cologne in celebration of two of their hottest launches of 2024: World of Warcraft®: The War Within™ and Diablo IV®: Vessel of Hatred™.

This year’s show promises to bring even more excitement, as Blizzard Entertainment will have a robust footprint alongside other Xbox Game Studios in the Xbox booth, as they come together to celebrate upcoming games and connect with the community in Europe and around the world.

“We are incredibly excited to bring Warcraft, Diablo, and Overwatch to our European community at gamescom,” said Johanna Faries, President of Blizzard Entertainment. “It’s wonderful to be able to travel to Cologne alongside some of our talented developers so that we can gather with players and celebrate the special connections that continue to be forged within our universes together.”

World of Warcraft will be celebrating the launch of The War Within, the first entry in the ambitious Worldsoul Saga. With the global launch set for August 26 - one day after gamescom - it’s the perfect opportunity for the community to celebrate together. Players with the Epic Edition or physical Collector’s Edition of The War Within can play when early access goes live on August 23rd.

Diablo will also be in full force at the event, bringing the world of Sanctuary to gamescom with Diablo IV: Vessel of Hatred and Diablo Immortal.

Overwatch 2 will have a joint stand with Porsche, highlighting their new collaboration featuring a life-sized D.Va statue modeled after the new all-electric Macan and inviting fans to enter a real-life rendition of an iconic Overwatch 2 map.

Some great news for Chinese players, as Blizzard have signed a new agreement with NetEase, and players will be returning to their games as early as summer 2024!
Most Blizzard games were suspended in January of 2023, with players losing access to their characters and being unable to play World of Warcraft, Hearthstone, Warcraft III: Reforged, Overwatch, the StarCraft series, Diablo III, and Heroes of the Storm, due to an expired licensing agreement. Luckily, a new deal has now been made!
A lot of WoW players decided to re-roll brand new characters on Taiwanese and Korean servers after the old deal stopped. Their old character data is saved, however, but it will be from back before patch 10.1, so it's going to be a tough decision on how to proceed for them. Perhaps Blizzard can come up with a solution to merge the accounts?
      Here's the full press release:

Blizzard games like World of Warcraft, Hearthstone, and Overwatch 2 might soon make a comeback in China, thanks to Blizzard reportedly teaming up again with NetEase.
The news comes from Core Esports, which suggests Blizzard's game services could be back by the end of March or the beginning of April.
After 14 years of partnership, Blizzard and NetEase hit a rough patch in 2022, leading to failed negotiations. Consequently, when the licensing agreement concluded on January 23, 2023, Blizzard's game services were suspended across mainland China.
For more details, you can check out the article in Chinese or find an English translation by Amy Chen on esports.gg.
